Terms of Use

1. Acceptance of Terms
These Terms of Use form a binding agreement between the user and OtoBoard Prep regarding access to and use of the OtoBoard Prep website, application, question bank, content, subscription services, and related features.
By accessing, registering for, subscribing to, or using OtoBoard Prep, the user confirms that the user has read, understood, and agrees to be bound by these Terms of Use, the Privacy Policy, Cookie Notice, Refund and Subscription Policy, Medical and Educational Disclaimer, and any additional terms displayed at checkout or within the Services.
If the user does not agree, the user must not access or use the Services.
2. Definitions
For purposes of these Terms:
- Account means the registered account used to access OtoBoard Prep.
- Authorized User means the single individual assigned to and permitted to use an Account.
- Content means text, questions, answer choices, explanations, tables, images, graphics, illustrations, videos, audio, software, analytics, data, metadata, user interfaces, and other materials.
- Educational Use means personal, individual, non-commercial study, exam preparation, and professional learning by the Authorized User only.
- Platform Content means all Content provided by or through OtoBoard Prep, including question stems, answer choices, explanations, images, tables, references, dashboards, analytics, and software.
- Services means the website, web application, question bank, subscription services, communications, and related OtoBoard Prep offerings.
- Subscription means paid access to the Services for a defined period or plan.
- User Content means information, feedback, notes, comments, reports, suggested questions, correction requests, or other content submitted by a user.
3. Eligibility
To use the Services, the user represents and warrants that the user:
- Is at least 18 years old and has legal capacity to enter into a binding agreement;
- Is using the Services for legitimate medical education, exam preparation, or professional learning;
- Will provide accurate and current account information;
- Is not prohibited from using the Services under applicable law;
- Will comply with these Terms and all applicable laws.
The Services are intended primarily for otolaryngology / ENT residents, physicians, medical students, interns, fellows, healthcare professionals, and related learners. The Services are not intended for children or for patients seeking medical advice.
4. Account Registration and Security
The user agrees to:
- Provide accurate, complete, and current information;
- Maintain the confidentiality of login credentials;
- Use only one Account unless OtoBoard Prep expressly authorizes otherwise;
- Not share, lend, sell, transfer, sublicense, or permit another person to use the Account;
- Promptly notify OtoBoard Prep of unauthorized access or suspected account compromise;
- Accept responsibility for all activity under the Account.
OtoBoard Prep may refuse registration, restrict access, suspend, or terminate an Account where it reasonably suspects inaccurate information, security risk, account sharing, abuse, non-payment, violation of these Terms, or unlawful activity.
5. Limited License
Subject to the user's compliance with these Terms and payment of applicable fees, OtoBoard Prep grants the user a limited, revocable, non-exclusive, non-transferable, non-sublicensable, personal, non-commercial license to access and use the Services and Platform Content solely for Educational Use.
No ownership interest is transferred to the user. All rights not expressly granted are reserved by OtoBoard Prep and its licensors.
6. Medical Education Only — No Medical Advice
OtoBoard Prep is an educational platform only. The Services and Platform Content do not constitute:
- Medical advice;
- Diagnosis;
- Treatment recommendation;
- Patient-specific guidance;
- Clinical decision support;
- Telemedicine;
- An electronic medical record;
- A clinical documentation tool;
- A medical device;
- A substitute for medical training, professional judgment, supervision, guidelines, institutional policies, or consultation with qualified professionals.
No physician-patient relationship, healthcare-provider relationship, advisory relationship, fiduciary relationship, or duty of care to any patient is created by use of the Services.
Users must not use OtoBoard Prep for patient care, clinical documentation, emergency care, diagnosis, treatment, or clinical decision-making.
7. No Guarantee of Results
OtoBoard Prep does not guarantee:
- Passing any examination;
- Achieving any score, percentile, ranking, or certification;
- Matching the content, format, difficulty, or emphasis of any future examination;
- Obtaining any residency, fellowship, job, license, promotion, or academic result;
- Achieving any clinical, professional, financial, or personal outcome.
Any performance score, predicted readiness, percentile estimate, dashboard metric, or progress indicator is an educational estimate only. It is not an official examination prediction or certification of competence.
8. Medical Accuracy Disclaimer
OtoBoard Prep aims to provide high-quality educational content, but medical knowledge changes, guidelines evolve, and educational content may contain errors, omissions, simplifications, outdated statements, or differences from local practice.
Users agree that they are responsible for independently verifying medical information using current authoritative sources before applying it in any professional, academic, examination, or clinical context.
To the maximum extent permitted by law, OtoBoard Prep is not responsible for any reliance on Platform Content.
9. Examination and Third-Party Organization Disclaimer
OtoBoard Prep is independent. Unless expressly stated in writing, OtoBoard Prep is not affiliated with, sponsored by, endorsed by, approved by, or certified by any examination body, licensing authority, medical board, university, hospital, professional society, residency program, publisher, or governmental authority.
Names of examinations, institutions, societies, organizations, trademarks, and third-party resources belong to their respective owners and are used only for identification or educational reference where applicable.
Users must not upload, request, share, reproduce, or distribute recalled, leaked, protected, copyrighted, or confidential examination material. Users must not suggest that OtoBoard Prep contains actual, official, recalled, or leaked examination questions.
10. Subscriptions and Payment
OtoBoard Prep may offer free, trial, promotional, and paid subscription plans. By purchasing a Subscription, the user agrees to pay all fees displayed at checkout, including applicable taxes and charges. Payment is processed by third-party payment processors.
Unless checkout expressly states otherwise, Subscription access lasts for the purchased term and may expire at the end of that term. If auto-renewal is offered and accepted, the user authorizes recurring charges until cancellation.
OtoBoard Prep may modify prices, plans, features, or availability at any time. Price changes do not affect the already-paid portion of a current fixed Subscription term unless required by law or expressly stated.
Failed payments, chargebacks, suspected fraud, or payment disputes may result in suspension or termination of access.
11. Free Trials and Sample Access
OtoBoard Prep may offer free sample questions, limited trials, or promotional access. Trial or sample access may be limited by time, question count, feature set, user, device, payment method, or other criteria.
OtoBoard Prep may modify, suspend, discontinue, or refuse trial access at any time. Abuse of trial access, including creating multiple accounts or using false information, may result in termination. Trial access does not guarantee continued access or access to the full question bank.
12. Cancellation
Users may cancel an active Subscription according to the cancellation method provided in the account settings, checkout terms, payment processor portal, or by contacting info@otoboardprep.com.
Unless applicable law or checkout terms state otherwise:
- Cancellation prevents future renewal but does not automatically refund the current paid term;
- Access continues until the end of the current paid term;
- After expiration, paid features become unavailable;
- Deleting an Account does not necessarily cancel a payment agreement handled through a third-party provider;
- Users remain responsible for cancelling through any applicable third-party payment or app-store system.
13. Refunds
To the maximum extent permitted by applicable law, all fees are non-refundable once digital access begins. OtoBoard Prep does not provide refunds for:
- Unused time;
- Change of mind;
- Accidental purchase;
- Dissatisfaction with content or features;
- Failure to pass an examination;
- Failure to achieve a score, career, academic, licensing, or professional outcome;
- Technical issues caused by the user's device, browser, internet connection, institutional restrictions, or local environment;
- Duplicate accounts created by the user;
- Violation of these Terms;
- Account suspension or termination for cause.
OtoBoard Prep may, at its sole discretion and without admitting liability, provide a refund, credit, extension, or other accommodation. Doing so in one case does not require OtoBoard Prep to do so in any other case.
Nothing in this section limits any non-waivable refund, withdrawal, or consumer-protection right that applies by law.
14. Intellectual Property Ownership
OtoBoard Prep and its licensors own all rights, title, and interest in the Services and Platform Content, including:
- Questions, stems, answer choices, and explanations;
- Educational objectives;
- Images, tables, charts, and illustrations;
- Software and source code;
- Databases and data structures;
- User interface design;
- Branding, logos, trade names, and visual identity;
- Study analytics and platform-generated reports;
- Compilations, organization, and arrangement of content.
The user receives only the limited license expressly granted in these Terms.
15. Strict Content Protection Rules
The user must not, directly or indirectly:
- Copy, reproduce, duplicate, photograph, screenshot, screen-record, download, print, archive, or store Platform Content except as expressly permitted by a built-in platform feature;
- Share Platform Content through WhatsApp, Telegram, Discord, Reddit, X/Twitter, Facebook, Instagram, TikTok, YouTube, Google Drive, Dropbox, GitHub, email, messaging groups, forums, courses, lectures, or any other public or private channel;
- Sell, resell, rent, lease, sublicense, publish, distribute, or commercially exploit Platform Content;
- Use Platform Content to create, improve, test, benchmark, or market a competing product;
- Use Platform Content to train, fine-tune, evaluate, benchmark, prompt, or develop artificial intelligence, machine-learning models, datasets, or automated systems;
- Scrape, crawl, harvest, extract, index, bulk-download, or systematically collect Platform Content;
- Use bots, scripts, automation, headless browsers, browser extensions, scraping tools, or non-human access methods;
- Reverse-engineer, decompile, disassemble, or attempt to derive source code, structure, architecture, security controls, or database design;
- Circumvent access controls, paywalls, authentication systems, rate limits, monitoring, watermarking, or anti-abuse systems;
- Share, sell, lend, transfer, or sublicense the Account or login credentials;
- Use the Services for public display, classroom teaching, group courses, institutional instruction, or commercial training without written permission;
- Memorize and reproduce Platform Content for redistribution or competitive use;
- Remove copyright, trademark, watermark, attribution, or proprietary notices;
- Use the Services in a way that infringes intellectual property, privacy, publicity, or other rights.
OtoBoard Prep may use watermarking, session monitoring, device signals, IP logs, behavioral analytics, rate limits, forensic markers, and other measures to detect and investigate misuse.
Violation of this section may result in immediate termination, loss of access without refund, legal action, and claims for damages, injunctive relief, and costs.
16. User Content and Feedback
If the user submits User Content, the user represents that the user has all rights necessary to submit it and that it does not violate law, confidentiality obligations, examination rules, intellectual-property rights, privacy rights, or these Terms.
The user must not submit:
- Patient data or identifiable health information;
- Confidential hospital, institutional, employer, or examination information;
- Recalled or leaked exam questions;
- Copyrighted material the user does not have permission to submit;
- Defamatory, unlawful, harmful, abusive, discriminatory, or misleading material;
- Malware or malicious code.
By submitting User Content or feedback, the user grants OtoBoard Prep a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable license to host, store, reproduce, modify, adapt, translate, analyze, use, display, distribute, and create derivative works from that content for purposes of operating, improving, securing, developing, and promoting the Services, subject to the Privacy Policy and applicable law.
OtoBoard Prep may review, edit, remove, or refuse User Content at any time, but is not required to monitor all User Content.
17. Acceptable Use
The user must not:
- Use the Services for unlawful, fraudulent, abusive, harmful, or deceptive purposes;
- Harass, threaten, defame, impersonate, or abuse any person;
- Attempt unauthorized access to accounts, systems, networks, or data;
- Probe, scan, or test system vulnerabilities without written permission;
- Interfere with security, availability, integrity, or performance of the Services;
- Introduce malware, spyware, ransomware, or harmful code;
- Use false identities, false payment information, or fraudulent subscriptions;
- Abuse support, refund, trial, or promotional systems;
- Violate examination confidentiality rules;
- Upload patient data or confidential third-party information;
- Use the Services for patient care or clinical decision-making;
- Violate any applicable law or regulation.
18. Suspension and Termination
OtoBoard Prep may suspend, restrict, or terminate access, with or without notice, if it reasonably believes that:
- The user violated these Terms;
- The user shared an account or credentials;
- The user copied, extracted, or redistributed Platform Content;
- The user engaged in suspicious, automated, excessive, or abnormal usage;
- The user failed to pay or initiated an improper chargeback;
- The user submitted prohibited content;
- The account creates a legal, security, payment, reputational, or operational risk;
- Termination is required by law, regulation, payment processor, or security necessity.
If an account is terminated for violation of these Terms, the user is not entitled to a refund except where required by law. Upon termination, the user must immediately stop using the Services and Platform Content. Sections intended to survive termination will remain in effect.
19. Platform Availability and Changes
OtoBoard Prep aims to provide reliable access but does not guarantee uninterrupted, error-free, secure, or continuous availability. The Services may be unavailable due to maintenance, updates, network issues, hosting failures, bugs, third-party outages, security incidents, force majeure events, or other reasons.
OtoBoard Prep may add, modify, suspend, restrict, or discontinue any feature, content, plan, or service at any time, to the maximum extent permitted by law.
20. Third-Party Services and Links
The Services may rely on or link to third-party services, including payment processors, hosting providers, authentication providers, analytics tools, email systems, reference materials, and external websites.
OtoBoard Prep does not control and is not responsible for third-party services, content, policies, security, availability, fees, or practices. Use of third-party services is subject to the third party's terms and policies.
21. AI-Assisted Features
If OtoBoard Prep offers AI-assisted educational features:
- AI outputs may be inaccurate, incomplete, biased, outdated, or hallucinated;
- AI features are for education only;
- AI outputs must not be used for patient care, diagnosis, treatment, documentation, or clinical decision-making;
- Users must independently verify AI outputs using authoritative sources;
- Users must not submit patient data, identifiable health information, confidential information, or examination material;
- AI features may be limited, modified, suspended, or discontinued at any time.
22. Beta Features
OtoBoard Prep may offer beta, experimental, preview, or early-access features. Such features are provided “as is,” may contain errors, may be changed or removed without notice, and may not become part of the final Services.
23. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Services and Platform Content are provided “as is” and “as available” without warranties of any kind, whether express, implied, statutory, or otherwise.
OtoBoard Prep disclaims all warranties, including warranties of accuracy, completeness, reliability, fitness for a particular purpose, merchantability, non-infringement, uninterrupted availability, error-free operation, security, compatibility, and achievement of any educational, examination, clinical, professional, or commercial outcome.
Some jurisdictions do not allow exclusion of certain warranties. In those jurisdictions, exclusions apply only to the maximum extent permitted by law.
24. Limitation of Liability
To the maximum extent permitted by applicable law, OtoBoard Prep and its owners, operators, contributors, contractors, licensors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or enhanced damages, including loss of profits, revenue, goodwill, opportunity, data, reputation, examination results, professional outcomes, licensing outcomes, employment outcomes, academic outcomes, clinical outcomes, or substitute services.
To the maximum extent permitted by applicable law, OtoBoard Prep's total aggregate liability arising out of or relating to the Services or these Terms will not exceed the greater of:
- The amount paid by the user to OtoBoard Prep for the Services during the twelve months before the event giving rise to the claim; or
- USD 100.
OtoBoard Prep is not liable for:
- Reliance on Platform Content;
- Clinical decisions or patient outcomes;
- Examination or career outcomes;
- User misuse;
- Account sharing;
- Unauthorized access caused by user failure to secure credentials;
- Third-party services;
- Payment processor issues;
- Network, hosting, or internet failures;
- User Content;
- Force majeure events.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, intentional misconduct, gross negligence, or other non-waivable rights where applicable.
25. Indemnification
To the maximum extent permitted by law, the user agrees to defend, indemnify, and hold harmless OtoBoard Prep and its owners, operators, contributors, contractors, licensors, service providers, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, and fees, including reasonable legal fees, arising out of or related to:
- The user's use or misuse of the Services;
- Violation of these Terms;
- Violation of law;
- User Content;
- Submission of patient data or confidential information;
- Account sharing or unauthorized access caused by the user;
- Intellectual-property infringement;
- Privacy violations;
- Examination confidentiality violations;
- Use of the Services for clinical care;
- Reliance on Platform Content for professional, clinical, examination, or academic decisions.
OtoBoard Prep may assume exclusive defense and control of any matter subject to indemnification. The user agrees to cooperate with the defense.
26. Intellectual Property Complaints
If a person believes that content on OtoBoard Prep infringes that person's copyright or intellectual-property rights, the person may send a notice to info@otoboardprep.com including:
- Identification of the protected work;
- Identification of the allegedly infringing material;
- Contact information;
- A statement of good-faith belief that use is unauthorized;
- A statement that the information is accurate and that the sender is authorized to act;
- A physical or electronic signature.
OtoBoard Prep may remove or disable content and may terminate repeat infringers where appropriate.
27. Governing Law and Venue
These Terms are governed by the laws of the Kingdom of Saudi Arabia, without regard to conflict-of-law principles.
To the maximum extent permitted by applicable law, any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the competent courts in Riyadh, Kingdom of Saudi Arabia.
OtoBoard Prep may seek injunctive or equitable relief in any competent jurisdiction to protect intellectual property, confidential information, platform security, or prevent misuse.
28. International Users
OtoBoard Prep is operated with a Saudi-first legal and operational assumption. Users who access the Services from outside Saudi Arabia do so at their own initiative and are responsible for compliance with local laws. OtoBoard Prep may restrict access in certain countries or regions at any time.
29. Export Controls and Sanctions
The user represents that the user is not prohibited from using the Services under applicable sanctions, export-control, or trade-restriction laws. The user must not use the Services in violation of such laws.
30. Changes to Terms
OtoBoard Prep may update these Terms from time to time. Updated Terms will be posted with a new “Last Updated” date. Where required by law or where changes are material, OtoBoard Prep may provide additional notice.
Continued use of the Services after updated Terms become effective means that the user accepts the updated Terms, except where applicable law requires additional consent.
31. Assignment
The user may not assign, transfer, or sublicense rights or obligations under these Terms without OtoBoard Prep's prior written consent.
OtoBoard Prep may assign or transfer these Terms in connection with a merger, acquisition, sale of assets, financing, restructuring, reorganization, or operation of law.
32. Severability
If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions remain in effect. The invalid provision will be enforced to the maximum extent permitted or replaced by a valid provision that most closely reflects the original intent.
33. No Waiver
Failure to enforce any provision of these Terms does not constitute a waiver. A waiver is effective only if in writing and authorized by OtoBoard Prep.
34. Entire Agreement
These Terms, together with the Privacy Policy, Cookie Notice, Refund and Subscription Policy, Medical and Educational Disclaimer, and checkout terms, form the entire agreement between the user and OtoBoard Prep regarding the Services.
35. Force Majeure
OtoBoard Prep is not liable for delay or failure caused by events beyond reasonable control, including natural disasters, war, terrorism, civil unrest, labor disputes, epidemics, pandemics, government actions, internet failures, utility failures, cyberattacks, payment processor failures, hosting provider failures, or other third-party service failures.

37. Survival
Sections concerning intellectual property, content protection, medical disclaimers, no guarantee, payment obligations, refunds, user content licenses, suspension effects, disclaimer of warranties, limitation of liability, indemnification, governing law, dispute resolution, and any provision that by nature should survive will survive termination or expiration.
